Condemnation of the Republic of Cyprus for Detention of Asylum Seeker

October 6, 2026

The European Court of Human Rights condemned the Republic of Cyprus for the unlawful and prolonged detention of a Moroccan asylum seeker from January 2019 to February 2020. The applicant claimed that his detention violated his right to personal liberty and that the review process for his detention did not meet fair trial standards. The Court found that the detention was arbitrary and excessively lengthy. However, it did not identify any violation regarding the review process. Ultimately, it emphasized that a swift conclusion to the asylum procedure would benefit the interests of both the applicant and the state.
